BLACKLISTED – MONTHLY PROMOTION

TERMS AND CONDITIONS

1. Promoter

The promoter is BLACKLISTED Pty Ltd (32 690 897 628) (“Promoter”).

2. Promotion Overview

This promotion is a trade promotion lottery conducted for promotional purposes only. Entry is determined by chance and winners are selected by random draw.

3. Eligibility

  1. Entry is open to Australian residents aged 18 years or over at the time of entry.

  2. Employees, contractors, agents of the Promoter, and their immediate families are ineligible to enter.

  3. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or breaches these Terms and Conditions.

4. Promotion Period

  1. The promotion commences and ends on dates to be specified in the Promotion Schedule (“Promotion Period”).

  2. Entries received outside the Promotion Period will not be accepted.

5. How to Enter

  1. Entry into the promotion is free.

  2. Entries are issued automatically to eligible participants as part of their ongoing engagement with the Promoter’s platform, including but not limited to membership loyalty.

  3. Entries cannot be purchased.

  4. The number of entries allocated to each participant is determined solely by the Promoter and may vary between participants.

  5. The Promoter is not required to publicly disclose the total number of entries or the number of entries allocated to any individual.

  6. Participants can view their own entry allocation via the Promoter’s platform.

6. Draw Details

  1. The draw will take place on the date and time specified in the Promotion Schedule.

  2. The draw will be conducted using an independent third-party draw platform to ensure randomness and fairness.

  3. The first valid entry drawn will be deemed the first prize winner, followed by subsequent valid draws for second and third prize winners.

7. Prizes

Prize Pool

  • First Prize: $1,000 AUD tattoo credit with a BLACKLISTED partner artist

  • Second Prize: $500 AUD tattoo credit with a BLACKLISTED partner artist

  • Third Prize: BLACKLISTED T-shirt and aftercare pack (total value $109.98 AUD)

Total maximum prize pool value: $1,609.98 AUD.

Prize Conditions

  1. Tattoo credits:

    • Are valid only with BLACKLISTED partner artists.

    • Must be redeemed by engaging a booking within six (6) months from the draw date.

    • Are not redeemable for cash, resale, or exchange.

  2. The winner is solely responsible for:

    • Selecting a partner artist;

    • Booking availability;

    • Any additional costs exceeding the prize value.

  3. The Promoter’s role is limited to facilitating payment to the partner artist. The Promoter is not a party to the tattoo service agreement.

  4. Tattoo services are provided entirely at the discretion and responsibility of the artist.

8. Health, Safety & Liability Disclaimer (Tattoo-Specific)

  1. Tattooing involves inherent medical and personal risks.

  2. By accepting the prize, the winner acknowledges and agrees that:

    • They are solely responsible for assessing medical suitability;

    • They must provide informed consent directly to the artist;

    • Any complications, reactions, dissatisfaction, or outcomes are solely between the winner and the artist.

  3. To the maximum extent permitted by law, the Promoter disclaims all liability arising from:

    • Tattoo procedures;

    • Artist conduct;

    • Medical outcomes;

    • Personal dissatisfaction with the prize.

9. Winner Notification & Publication

  1. Winners will be notified via the contact details associated with their account.

  2. If a winner does not respond within seven (7) days of notification, the Promoter reserves the right to redraw.

  3. By entering, entrants consent to the publication of their first name, last initial, state/territory, image, and/or likeness for promotional purposes without further compensation.

10. Prize Substitution & Force Majeure

  1. If a partner artist becomes unavailable, the Promoter may substitute the artist with another partner artist of equivalent value.

  2. The Promoter reserves the right to vary, suspend, or cancel the promotion if circumstances arise beyond its reasonable control.

  3. Except where required by law, prizes are not transferable or exchangeable.

11. Privacy

  1. Personal information is collected and used in accordance with the Promoter’s Privacy Policy.

  2. Information may be used for the purpose of administering the promotion and for related marketing activities.

12. General Conditions

  1. The Promoter’s decisions are final and binding.

  2. The Promoter reserves the right to disqualify any entrant engaged in fraudulent or misleading conduct.

  3. To the maximum extent permitted by law, the Promoter excludes all warranties and limits liability for loss or damage suffered in connection with the promotion.

  4. These Terms and Conditions are governed by the laws of Australia.

  5. These Promotion Terms and Conditions operate independently of and override any inconsistent membership terms.

BLACKLISTED – MEMBERSHIP

TERMS AND CONDITIONS

1. Operator

Memberships are operated by BLACKLISTED Pty Ltd (32 690 897 628) (“BLACKLISTED”, “we”, “us”, “our”).

2. Membership Overview

  1. BLACKLISTED offers tiered membership products that provide access to benefits including promotional entries, discounts, and other discretionary perks.

  2. Membership does not guarantee winning any prize.

  3. Membership benefits are provided subject to these Terms and Conditions.

3. Membership Eligibility

  1. Membership is open to individuals aged 18 years or over who are Australian residents.

  2. By purchasing a membership, you warrant that all information provided is accurate and current.

  3. BLACKLISTED may refuse, suspend, or terminate membership at its discretion in accordance with these Terms.

4. Membership Types

BLACKLISTED offers two membership formats:

4.1 Once-Off 30-Day Membership

  1. A once-off membership provides access for 30 days only from the date of purchase.

  2. Once-off memberships do not automatically renew.

  3. Membership benefits expire at the end of the 30-day period unless a new membership is purchased.

4.2 Recurring Membership

  1. Recurring memberships are billed monthly in advance via direct debit or credit/debit card.

  2. Membership continues until cancelled by the member or terminated by BLACKLISTED.

  3. Recurring members receive additional benefits, including compounding promotional entries, as outlined below.

5. Membership Tiers & Pricing

Current Tiers

  • Silver — $6.99 AUD / month

    • 1 promotional draw entry per membership period

    • 10% discount on BLACKLISTED merchandise and aftercare

  • Gold — $12.99 AUD / month

    • 5 promotional draw entries per membership period

    • 20% discount on BLACKLISTED merchandise and aftercare

  • Black — $19.99 AUD / month

    • 10 promotional draw entries per membership period

    • 30% discount on BLACKLISTED merchandise and aftercare

Pricing Changes

  1. BLACKLISTED reserves the right to change membership pricing, tiers, or inclusions at any time.

  2. Any pricing changes will apply prospectively and will not affect the current billing period.

  3. Continued membership after a pricing change constitutes acceptance of the updated pricing.

6. Promotional Entries & Accumulation

  1. Promotional entries are allocated based on membership tier and active status.

  2. For recurring memberships, entries accumulate month-to-month while the membership remains active.

  3. If a membership is cancelled or lapses for any reason:

    • All accumulated entries are reset.

    • Entries do not carry over to a future membership.

  4. If a promotional draw occurs during a period for which membership fees have been paid, the member remains eligible for that draw even if cancellation occurs prior to the draw date.

  5. Entry allocation mechanics and draw rules are governed exclusively by the applicable Promotion Terms & Conditions.

7. Discounts & Perks

  1. Membership discounts apply only to eligible BLACKLISTED products and services as determined by BLACKLISTED.

  2. Discounts:

    • Cannot be exchanged for cash

    • Cannot be combined unless expressly stated

  3. All perks, benefits, and inclusions are provided on a discretionary basis.

  4. BLACKLISTED may add, modify, or remove perks at any time without compensation.

8. Billing, Failed Payments & Grace Period

  1. Recurring memberships are billed automatically each month.

  2. If a payment fails:

    • A seven (7) day grace period applies.

    • Membership benefits may be suspended during this period.

  3. If payment is not successfully processed within the grace period:

    • Membership may be cancelled automatically

    • Accumulated entries will be forfeited

9. Cancellation

  1. Members may cancel a recurring membership at any time.

  2. Cancellation is effective at the end of the current billing period.

  3. No partial refunds or credits apply for unused time.

  4. Once cancelled, membership benefits cease at the end of the paid period.

10. Refunds & Cooling-Off

  1. No refunds are provided for change of mind, unused time, or failure to participate.

  2. No cooling-off period applies, except where required by Australian Consumer Law.

  3. Nothing in these Terms limits any rights you may have under Australian Consumer Law.

11. Accounts & Use

  1. Members may maintain more than one account; however, BLACKLISTED is under no obligation to consolidate benefits, entries, or perks across accounts.

  2. BLACKLISTED reserves the right to investigate and act upon fraudulent, abusive, or misleading conduct.

  3. BLACKLISTED may suspend or terminate accounts without notice where misuse is suspected.

12. Communications & Marketing

  1. By becoming a member, you consent to receive communications via email and/or SMS regarding:

    • Membership

    • Promotions

    • Platform updates

  2. You may opt out of marketing communications at any time; however, essential membership communications may still be sent.

13. Relationship to Promotions

  1. Membership provides eligibility and entries only.

  2. Membership does not guarantee any prize or outcome.

  3. All giveaways, draws, and prizes are governed by the relevant Promotion Terms & Conditions, which prevail in the event of inconsistency.

14. Limitation of Liability

  1. To the maximum extent permitted by law, BLACKLISTED excludes all warranties not expressly stated.

  2. BLACKLISTED is not liable for indirect, incidental, or consequential loss arising from membership use.

  3. Liability is limited to the minimum required under Australian Consumer Law.

15. Termination by BLACKLISTED

BLACKLISTED may suspend or terminate membership at its sole discretion, including where:

  • These Terms are breached

  • Fraud or misuse is suspected

  • Continued provision becomes impractical or unlawful

16. Governing Law

These Terms and Conditions are governed by the laws of Australia.

 

 


BLACKLISTED – PARTNERED ARTIST

TERMS AND CONDITIONS

1. Parties & Relationship

  1. These Terms apply between BLACKLISTED Pty Ltd (“BLACKLISTED”, “we”, “us”) and the approved partnered tattoo artist (“Artist”, “you”).

  2. The Artist is engaged as an independent contractor.

  3. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.

  4. The Artist has no authority to bind BLACKLISTED.

2. Eligibility & Approval

  1. Artists must:

    • Be Australian residents;

    • Be legally entitled to provide tattoo services in Australia;

    • Hold all required licences, registrations, permits, and approvals.

  2. Artist participation is subject to BLACKLISTED’s sole discretion.

  3. BLACKLISTED may approve, reject, suspend, or remove any Artist at any time.

3. Exclusivity & Non-Compete

  1. While partnered with BLACKLISTED, the Artist:

    • Must not participate in, promote, or offer tattoo giveaways, lotteries, or similar promotions through any competing platform.

  2. This exclusivity applies Australia-wide for the duration of the partnership.

  3. Nothing restricts the Artist from operating their own studio or accepting private clients outside competing giveaway platforms.

4. Artist Obligations

The Artist agrees to:

  1. Comply with all applicable:

    • Health and hygiene regulations

    • Licensing and council requirements

    • Insurance obligations

  2. Maintain appropriate public liability and professional insurance.

  3. Conduct themselves in a manner that does not bring BLACKLISTED into disrepute.

  4. Ensure all tattoo services are provided with appropriate consent, aftercare advice, and professional standards.

5. Prize Fulfilment & Booking

  1. Winners book directly with the Artist.

  2. The Artist must commence tattoo work within six (6) months of the relevant prize draw.

  3. BLACKLISTED is not responsible for booking availability, scheduling, or artistic outcomes.

  4. If a winner fails to attend an appointment or cancels outside the Artist’s cancellation policy:

    • The prize is forfeited; and

    • The Artist remains entitled to payment.

6. Payment Terms

Prize Payments

  1. BLACKLISTED pays the Artist directly for prize tattoos.

  2. Payment occurs upon completion of the tattoo work.

  3. Payment may be made in instalments where the prize value is redeemed across multiple sessions.

  4. Payments are processed automatically without invoice.

Commission

  1. BLACKLISTED will pay the Artist a 20% commission on membership revenue generated via the Artist’s unique referral or discount code.

  2. Commission is payable only while the Artist remains an active partnered artist.

  3. Commission payments cease immediately upon termination.

7. No Guarantees

  1. BLACKLISTED makes no guarantees regarding:

    • Number of winners selecting an Artist

    • Volume of work

    • Commission income

  2. Selection by winners is entirely discretionary.

8. Liability, Risk & Indemnity

  1. The Artist acknowledges that:

    • Tattooing involves inherent medical and personal risks.

    • All tattoo services are provided solely by the Artist.

  2. BLACKLISTED has no liability for:

    • Tattoo outcomes

    • Medical complications

    • Client dissatisfaction

  3. The Artist indemnifies BLACKLISTED against all claims, losses, damages, penalties, and costs arising from:

    • Tattoo services

    • Regulatory breaches

    • Injury or harm

    • Reputational damage caused by the Artist’s conduct

9. Marketing, IP & Content

  1. The Artist grants BLACKLISTED a royalty-free, perpetual licence to use:

    • Artist name and studio name

    • Images, videos, and content of tattoo work

    • Likeness and branding
      for marketing and promotional purposes.

  2. The Artist agrees to provide images or content upon reasonable request.

10. Conduct & Reputation

  1. The Artist must not engage in conduct that may:

    • Harm BLACKLISTED’s reputation

    • Be unlawful, offensive, or discriminatory

  2. BLACKLISTED may remove the Artist immediately for reputational risk.

11. Confidentiality

  1. The Artist must keep confidential:

    • Commercial terms

    • Platform mechanics

    • Internal processes

  2. This obligation survives termination.

12. Term & Termination

  1. This agreement operates on an ongoing basis until terminated.

  2. BLACKLISTED may terminate the partnership:

    • At any time

    • For any reason

    • Without notice

  3. The Artist may terminate by written notice.

  4. Upon termination:

    • All future payments and commissions cease

    • The Artist is removed from the platform

    • Existing winners may select an alternative partnered artist

13. Effect of Termination on Prizes

  1. If an Artist is terminated before a prize is redeemed:

    • The winner may select another partnered Artist

    • BLACKLISTED has no obligation to the terminated Artist

14. Limitation of Liability

  1. To the maximum extent permitted by law, BLACKLISTED excludes all warranties.

  2. BLACKLISTED’s liability is limited to the minimum required under Australian Consumer Law.

15. Governing Law

These Terms are governed by the laws of Australia.
